Defense counsel hereby gives notice of a conflict with a date that the Court has set for a Status Hearing regarding the remand of this matter to this Court by the Ninth Circuit Court of Appeals. The Court has set a Status Hearing on September 11, 208 at 3:00 p.m. Defense counsel J. Greg Coulter has pre-existing travel plans out of state, and has a flight departing Phoenix International Airport at 4:30 p.m. on September 11, 2008. Due to check-in and other travel requirements, defense counsel is unable to appear at 3:00 p.m. as scheduled by the Court. Consequently, Defendants request that the Court reset the Status Conference.
