18 On June 28, 2005, the Court granted Defendants’ Motion to Dismiss and entered
19 judgment in Defendants’ favor. (Doc, # 79-80.) On July 25, 2005, Plaintiff TransCore
20 filed a Notice of Appeal. (Doc. # 81.)
21 The parties have now entered into a settlement agreement whereby TransCore’s
22 appeal shall be voluntarily dismissed. Pursuant to that agreement, the parties stipulate
23 that the Court should exonerate the bonds posted by TransCore in this matter; (1) Bond
24 on Replevin in the amount of $2].5,000.00, Bond No. CMS217505; and (2) Bond on
25 Temporary Restraining Order in the amount of $100,00000, Bond No. Cl\/IS217506.
