14 Comes now Plaintiff mentioned above to Motion the Court for its Order granting Plaintiff
15 permission to have certain affidavits struck from the record to be replaced with Affidavits attached
16 hereto. Plaintiff has in the following Memorandum of Points and Authorities set forth more fully why
17 the Court should grant this request.
. 18 MEMORANDUM OF POINTS AND AUTHORITIES
.. 19 Pro Se Plaintiff in this matter has discovered that certain affidavits he has included with his
20 objection to all defendants motions for Summary Judgment were perhaps not in proper fomiat to be
21 considered by this Court when determining the Summary Judgment motions currently before it.
22 The proposed corrected Affidavits contain the same affirmations as Affidavits plaintiff wishes
° · 23 to strike with the exception of technical affirmative declaration included within each such affidavit.
24 The affidavits were mistakenly formatted as being swom of affiant best of knowledge when in fact
25 said affidavits are indeed based upon affiant personal knowledge.

,- 1 Plaintiff makes the motion to the court in his continuing good faith effort to substantially
· 2 comply with the Federal Rules of Procedure. This motion is not intended to needlessly increase the
3 cost of this action, cause un necessary delay the resolution, but in the interests of being procedurally
4 compliant in plaintiffs filings in this court.
