17 appeal to the`Ninth Circuit Court of Appeals from the ju1·y’s verdict and from the Court’s
18 August 3, 2006 Order denying Defendants·’ Motion for Judgment as a Matter of Law.
19 This- Notice of Appeal is fled out of an abundance of caution due to the
2.0 unique- posture of this case. Although Defe11dants’ Motion for Judgment as a Matter of
2`I Law was made at trial pursuant to Fed. R. Civ. P. 5‘0`(a), the Court ·did not rule on the
22 Motion until alter trial. Defendants have now filed a renewed Motion for Judgment as a
23 Matter of Law pursuantto Fed. R. Civ. P. 50(b), and believe that Motion extends the time
24 for appeal under FRAP e4(a)(1._)(4). Nonetheless, Defendants are filing this Notice of
25 Appeal so there is no question about whether they have preserved their appeal rights.
