16 Plaintiff submits the following Stipulated Proposed Statement of the Case: A
17 Plaintiff, a prisoner in the Arizona Department of Corrections, has brought a 42
18 U.S.C § 1983 civil rights action asserting that Defendant James violated his First
19 Amendment rights by retaliating against Plaintiff for accessing the courts to file a 42 _
20 U.S.C. § 1983 civil action lawsuit against Defendant James’ colleague and/or friend,
2] Jennifer Thelen. Plaintiff asserts that Defendant James assaulted, had false reports
22 filed against, and maliciously prosecuted Plaintiff. The Plaintiff seeks compensatory
23 and punitive damages.
24 Defendant denies Plaintiffs allegations that he retaliated against Plaintiff.
2 5 Defendant claims that Plaintiff failed to follow a direct order given by Defendant and
26 consequently, Defendant used the amount of force reasonably necessary to enforce the

l inmate’s compliance with prison rules and for the safe and orderly operation of the
2 prison.
