16 Defendant James submits the following Proposed Statement of the Case:
17 Plaintiff, a prisoner in the Arizona Department of Corrections, brings a 42
18 U.S.C § 1983 civil rights action alleging that Defendant James violated his First
19 Amendment rights by retaliating against him for accessing the courts when he tiled a
20 42 U.S.C. § 1983 civil action lawsuit against Defendant James’ colleague and/or
21 friend, Jennifer Thelen. Plaintiff seeks compensatory and punitive damages.
22 Defendant denies Plaintiffs allegations that he retaliated against Plaintiff.
23 Plaintiff failed to follow a direct order given by Defendant and then assaulted him. As
24 a result of the assault on staff, Defendant used the amount of force reasonably
2 5 necessary to enforce the inmate’s compliance with prison rules and for the safe and
26 orderly operation ofthe prison.
