Pending motions discussed. The Court rules as follows: deeming moot [doc. 173] Plaintiff's Motion to Appear Telephonically; granting in part [doc. 151] Plaintiff's Motion to be Unrestrained. Plaintiff's hands may remain unrestrained unless the defendants provide information to the Court that this particular plaintiff requires further restraint; granting [doc. 153] Defendants' Motion to Supplement Their Proposed Model and Non-Model Jury Instructions; denying as moot [168] Plaintiff's Motion for Extension of Time to File Response to Defendants' Motion to Supplement. Plaintiff's proposed witness list discussed. Regarding in-custody plaintiff witnesses, the plaintiff indicates he will not call Eric Cobb, Shawn Johnson and Tony Jackson to testify but is requesting writs be issued for Cameron Walker, Leonard Brent and Andrew Love. The Court advises the plaintiff that if the above-named witnesses are still in custody, writs will issue for their appearance at trial. IT IS ORDERED directing defense counsel to notify plaintiff before March 1, 2007, the names of the witnesses that will be made available to testify at trial in addition to witnesses James and Fridenmaker. IT IS FURTHER ORDERED setting Jury Trial on March 27, 2007, at 9:00 a.m. Estimated trial length: 4 days. IT IS FURTHER ORDERED plaintiff is to file no later than March 1, 2007, a supplement to his witness list stating the expected testimony of his witnesses and to mail a copy to defense counsel. Settlement discussed. Plaintiff having indicated he is amenable to settlement discussions, defense counsel requests the plaintiff submit it to defense counsel in writing.
