The undersigned hereby stipulate and request the Court enter an order increasing the page limit for the response to the parties Motion for Summary Judgment to thirty (30) pages. On December 29, 2005, the Receiver filed the Receiver's Motion for Partial Summary Judgment on Count Nine Against Defendants: Leonard and Elizabeth Bestgen, Renald Bidwell, Robert Carroll, Rudy and Mary Crosswell, Charles Davis, Richard Derk, Orville Dale Frazier, Ronald Allen Kerher, Dwight Lankford, John and Candes Rada, Paul Richard and Patrick Wehrly.

On December 30, 2005, the attorney for the Defendants filed the Rada Defendants' Motion for Summary Judgment. Plaintiff`s motion for summary judgment is thirty-eight (38) pages in length. Counsel for the Defendants filed a Motion for Summary Judgment and Memorandum of Points and Authorities which is fifty-eight (58) pages in length. Pursuant to L.R. Civ. 7.2(e), the response to a motion for summary judgment shall not exceed seventeen (17) pages. Here, good cause exists, based on the size of the summary judgment motions to expand this limitation for the response as contemplated under L.R. Civ. 7.2(e). In order to address all of the issues raised in these motions for summary judgment, the parties request the Court allow the page limitation for each side's response be increased to thirty (30) pages.
