Pursuant to Rule 26(c), Federal Rules of Civil Procedure, Defendant Leonard Bestgen

("Bestgen"), through his undersigned attorney, hereby moves the Court for a Protective Order
17

from the Notice of Deposition previously served upon said Defendant requiring him to appear
18

for his deposition on September 28, 2006, and asks instead that the Deposition be postponed
19

indefinitely, for the reason that an Appeal has been filed in this matter by the Rada Defendants,
20

which includes Defendant Bestgen. The undersigned's staff have been in touch with Mr.
21

Anderson, who stated that he intended to proceed with the deposition.
