NON—TAXABLE EXPENSES

15 Pursuant to LRCiv 54.2. (the °°Rule"), Best Western International, Inc. ("Best

17 Western”) hereby moves the Court for an award of attorney’s fees and non—taxable
18 expenses in the above-entitled action.
I9 By order dated August 30, 2005, this Court entered default against defendant Ohio
20 Key I, Inc. ("Ohio Key"). By order dated May 22, 2006, this Court entered default
21
22 against defendant Nathan A. Roesing ("Roesing") pursuant to F ed. R. Civ. P. l6(f). The
23 Court also directed Best Western to submit this motion along with its supporting
24 memorandum of points and authorities within fifteen (15) days ofthe judgment.

I Accordingly, Best Western now moves the Court for an award of attorney’s tees
2 and related non~taxable expenses pursuant to A.R.S. §l2-341.01 and Paragraph 36 ofthe
3 parties’ contract at issue herein.] Best Western requests that the Coun award it attorney’s
4
fees in the amount of $22,284.00 and non-taxable expenses in the amount of $2,502.15
5
6 against Roesing, and attorney’s fees in the amount of $10,807.50 and non-taxable
7 expenses in the amount of $702.79 against Ohio Key.2 This motion is supported by the
8 Memorandum ofPoints and Authorities filed herewith.
