18 The United States of America and Robert Moseley, by and through
19 their undersigned counsel and pursuant to the Court's prior order,
20 hereby submit as follows:
21 The parties have settled this action. However, the Internal
22 Revenue Service has not yet issued the check for the settlement amount
23 to the plaintiff. Once the check has been received by the plaintiff’s
24 counsel, the parties will file a stipulation that this action be
25 dismissed with prejudice, with each party to bear its own costs,
26 including any possible attorney’s fees or other expenses of this
27 litigation. Counsel for the United States anticipates receiving the
28 check from the Internal Revenue Service by approximately September 26,

1 2005. Accordingly, the parties request an extension of time to and
2 including October 3, 2005 to file their stipulation for dismissal.
