NOTICE OF RECENT AUTHORITY Defendant Mike Leavitt, Secretary of Health and Human Services ("HHS") (hereinafter "the Secretary"), hereby files this notice regarding a continuation of the stay of litigation in this case. The Secretary states the following: 1. On March 10, 2005, this Court stayed this case pending the outcome in Spry v.
Thompson, No. 04-35746. 2. 3. The Ninth Circuit issued a decision in Spry on May 21, 2007. On June 11, 2007, the Secretary filed a notice of the Spry decision with this

On June 25, 2007, Plaintiffs filed a Response in Opposition to Defendant
Michael Leavitt's Notice of Recent Authority. 5. In that response, Plaintiffs indicated that the attorneys for the Spry plaintiffs,
one of whom is also counsel for Plaintiffs in this case (Martha Jane Perkins), planned to file a petition for rehearing en banc of the Spry decision. 6. Plaintiffs argued that their planned en banc petition meant that this Court
should continue its stay and should not address the parties' pending summary judgment. 7. In light of the Plaintiffs' representation that the Spry plaintiffs will be seeking
en banc review, the Secretary has no opposition to the continuation of the stay until the petition is resolved. 8. The Secretary believes that the issue of further briefing and the page limits
for further briefing should be addressed after the Spry petition is resolved. Respectfully submitted this 28th day of June, 2007.
