4 2. All counsel engaged in good faith settlement discussions. There does not
5 appear, at this juncture, the possibility of settling the claims against Defendants Ray
6 individually. They may, however, be included in any settlement made by the other
7 Defendants. With respect to Defendants Terravita Country Club, lnc., Terravita Golf l

8 Club, Inc., Burnett and Michaelson, l\/ls. Jacobs-Schwartz placed an opening 2
9 l
10 settlement offer on the table for consideration. lVlr. Silvyn will communicate the offer 1
11 to his clients, and present any counter-offer thereto by next week. lf it appears 1
12 mediation may be productive once the settlement offer/counter-offer is exchanged,
13 that possibility will be explored.
