The parties, by and through undersigned counsel, hereby submit in compliance with the court's order of December 5, 2005, their status report. Since the last status report was submitted, counsel for the Postal Service has left employment with the U. S. Attorney's Office and Michael A. Johns has entered an appearance on behalf of defendant. Mr. Johns is the Chief of the Civil Division for the District of Arizona. Due to Ms. Bernick's departure, no progress was made on finalizing the settlement agreement. Counsel have spoken about the current status of this case

and are both committed to working together to bring this matter to closure in a prompt manner. The text issues that remain to be resolved in the settlement agreement are less than five. If Judge Pyle's assistance is needed to resolve any final text issue, he will be contacted promptly. Counsel should have all text issues resolved by January 31, 2006.
