Res ondents.

A 19 Counsel for Steven Craig James move the Court for an order extending the
20 deadline for any motion for reconsideration of the Court’s July 24, 2006, order. We
21 request an extension until September 20, 2006.
22 We have not determined whether any such motion will be filed. If it is, Gary
23 Lowenthal, lead counsel for James, will be the person with principal responsibility for
24 writing it. He has been and will remain out of state through Labor Day.
25 The Court’s July 24 order provided 15 days for filing a motion for reconsideration.
26 This motion asks for 15 days following Mr. Lowenthal’s return to Phoenix. No previous

1 requests regarding such a motion have been made.
2 We regret not bringing this motion sooner. When reviewing the Court’s July 24 ‘
3 order, we simply, and mistakenly, glossed over the deadline, or in other words, we
4 missed it. We ask the Court not to visit the consequences of our negligence on our
5 client.
6 We have notified Robert Gorman of the State Attomey General’s Office of our
7 intent to file this motion, and he graciously told us that he had no objection.
8 We avow that this motion is in the interests of justice and not made for purposes of
9 delay.
