20 deadline for tiling the Memorandum Re: Merits requested by the Court in its July 24,

22 This request is made because Gary Lowenthal, lead counsel for James and the "
23 I person who will have principal responsibility for writing the Memorandum, has been and
24 will remain out of state through Labor Day. Indeed, Mr. Lowenthal has been out of the
25 I country since early July, and although he will retum to the United States before Labor
26 . Day, he will be working out of state and not return to Phoenix until then. .
