CASE MANAGEMENT ORDER NO. 3 In order to update, supplement, and/or reiterate some of the procedures set forth by the Court in its previous orders, IT IS ORDERED that: 1. The Rules of Practice of the United States District Court for the District of Arizona, as amended effective December 1, 2005, shall govern this MDL action unless otherwise ordered by the Court. The Court's local rules and other practices and procedures applicable to litigation before this Court may be found on the Court's website: www.azd.uscourts.gov. All counsel participating in this MDL action shall familiarize themselves with the Court's local rules and procedures. 2. All documents filed with the Court shall be filed electronically pursuant to the Court's Electronic Case Filing (ECF) policy, unless otherwise stated by that policy or by the Court. The Court's ECF policy and procedures are set forth on the Court's website. 3. All documents shall be filed in MDL No. 1541 (using case number 2:03Document 120 Filed 02/09/2006 Page 1 of 2

All documents shall be captioned using the MDL case title, and when such documents relate to all of the member cases, the MDL number shall be followed by the notation "ALL CASES"; if a document relates to less than all of the member cases, the individual District of Arizona (Phoenix Division) case numbers shall also be listed. 4. Inasmuch as the Court is now operating under its ECF system, all counsel who have complied with the Court's ECF registration policy will receive notice of all of the Court's orders and other documents issued by the Court.1 All counsel now participating in this action who have not yet complied with the Court's ECF registration policy are directed to do so as soon as possible if they wish to continue receiving copies of Court orders and other Court-issued documents. 5. Commencing on March 1, 2006, the Clerk of the Court is directed to cease mailing paper copies of Court orders and other Court-issued documents to counsel in this action who have failed to comply with the Court's ECF registration policy.2 DATED this 8th day of February, 2006.

However, if the Court for some reason has to communicate telephonically with counsel, it will only do so with the parties' administrative liaison counsel, and only those counsel (and their staffs) may communicate telephonically with the Court. The Court notes that as of February 6, 2006, the Clerk of the Court has been mailing paper copies of the Court's orders to the following twelve counsel: Jennifer Barnett, Kimberly Cilke, Suzanne Freyer, Hal Gillespie, William Hershman, Cheryl Hipp, Ronald James, Charles Jones, George McCaffrey, David Millstone, George Sintsirmas, and Christian Torres.
