17 COMES NOW, the Petitioner, Jorge Avina~De Anda, acting in
18 Sropria persona, respectfully submits this Motion to Request an
19 ppointment of Counsel and the Speedy Trial Act for Existing Pro-
20 .ation Violation and/or to Terminate Probation and for Counsel that
. 21 `s Appointed to Represent the Petitioner in Absentia, pursuant to
22 ll Federal Rules, Regulations, and Procedures.
23 The Petitioner is currently incarcerated at the Federal
24 .orrectional Institution—Victorville I in Adelanto, California.
7 25 eing incarcerated, the Petitioner is without and lacking counsel.
26 etitioner prays that this Motion will suffice the Court in the
27 roper filing and procedure. V
28 ~The Petitioner is currently serving a 37 month sentence on
ase 2:04-cr-00164-PGR Document 48 Filed O9/27/2007 Page 1 of 4

. 1 a new charge/case (Case No. 05-CR—2l52-JM/Southern District of
2 California). The Petitioner has been incarcerated since September
3 5, 2006. The Petitioner's tentative release date is October 5,2MD
4 Upon release, the Petitioner has a three (3) year intense Super-
5 vised Release. The Petitioner will also be returned to Mexico via
h 6 the Immigration and Customs Enforcement.
7 The pending case within this Honorable Court's jurisdiction
8 is impeding the Petitioner's programming, security level, classi— _
9 fication, and schooling.
10 THEREFORE, the Petitioner respectfully requests that this
. 11 Honorable Court Appoint Counsel to represent the Petitioner in
V 12 ABSENTIA to adjudicate the pending Probation Violation. The Peti-
_ 13 tioner would request that this Hanaxabie Court run the existing
14 robation Violation CONCURRENT with existing New Case/Charge with
15 he seuthexa District of California. i
16 In the alternative, the Petitioner respectfully requests
17 hat this Honorable Court TERMINATE the existing Probation within
18 his Court's jurisdiction.
‘ 19 FURTHERMORE, the Petitioner would respectfully request, pur
20 uant to the Speedy Trial Act and the Interstate Compact Agreement,
, 21· hat this Honorable Court adjudicate the Probation Violation within
22 he allotted 90 (ninety) days to 180 days upon receipt of this
23 otion. Due to the Petitioner's filing of this Motion in due~
24 iligence, the Petitioner would also respectfully request that this
25 onorable Court lift all outstanding warrants/detainers/U.S. Marek
26 hal's Holds. The Petitioner is already in Federal Custody and
27 erving time. U
28 The Petitioner has shown good faith and good cause to GRANT
