This motion to continue sentencing is granted pursuant to U.S.C. Section 3161(h)(8)(A). This Court specifically finds that the ends of justice served by granting a continuance outweigh the best interests of the public and of the defendant to a speedy trial. This finding is based upon the Court's conclusion that failure to grant a continuance would deny counsel for the defendant the reasonable time necessary for effective preparation, taking into account the exercise of due diligence. 18 U.S.C. Section 3161(h)(8)(B)(iv). IT IS ORDERED continuing the sentencing from August 22, 2005, to September 26, 2005, at 3:30 p.m. v. JOSEPH PATRICK SMITH, III, Defendant.
