FOR 45 DAYS.
TO THE HONORABLE JUDGE OF SAID COURT,
Comes now, Lawrence Leon Jackson, acting in pro—se and files
I this motion to hold in abeyance the government's response in opp-
osition to movant's § 2255 motion or in the alternative motion for
A extension of time 45 days to file reply. In support thereof, movant
states as follows:
l. On October 24, 2007, the government filed a "motion to sum- `2
marily dismiss" (#137), arguing that movant's refusal to waive his
I _ attorney client privile|@·precluded respondent from answering the _
i motion to vacate. Respondent argued that the court should either
summarily dismiss the motion to vacate, or find an implicit waiver -
adequate to allow a response.
2. On December 18, 2007 this court ordered movant to respond
to the respondent's motion to summarily dismiss, filed October 24,
2007 (#137), within I0 days. .
3. On December 19} 2007 movant filed his timely response to the
court order in which movant denies any refusal to waive attorney
client privilege and therefore waives his attorney client privilege

to the extent necessary to give the government a fair oppurtunity
to defend against the charges as set forth in Qittaker v. Woodford, I
331 F. 3d 715 (9th Cir 2003).
U 4. Not withstanding the governments allegations that movant's
refusal to waive his attorney client privilege precluded respondent -
from answering the motion to vacate, the government has filed it's
response in opposition to movant's § 2255 motion dated on December (
19, 2007, post marked December 28, 2007 to which movant recieved on
Jaunuary 4th, 2008: ~* c · . "
5. The government in its response states that movant has the
ability to allow defense counsel to respond to the allegations, yet,
he has chosen to restrict defense counsel's ability to do so and that
movant has shown that he is not willing to waive that privilege.
6. It appears that the government's response to movant's § 2255 (
i motion is pre-mature and movant would request for this court to hold
i in abeyance till the disposition of the preliminary matter pending
regarding the waiver of attorney client privilege.
7. Due to the institutional lockdown on January 4, 2008 movant p
was not able to access the law library or his legal materials. There-V

8. In the alternative, movant would request a 45 day extension
of time to reply to the premature government's opposition of movant's
§ 2255 motion, if this court finds it appropriate and in accordance
with due process.
- PRAYER
Wherefore, movant prays that this court will grant him the
motion and hold in abeyance the government's response till the dis-
position of the preliminary matters involving waiver of attorney
