CR 04-00404-1-PHX-JAT ORDER REVOKING SUPERVISED RELEASE
A Petition to Revoke Supervised Release has been filed and defendant has admitted the allegations that he violated Special Condition #9 and Special Condition #1 of his conditions of supervised release. The Court finds the defendant has violated the terms and conditions of supervised release and has considered the factors in 18 U.S.C. ยง 3553, the U.S. Sentencing Commission Chapter 7 policy statements, as well as the original guideline range, the original sentence imposed by this Court, the presentence report in the underlying matter, and the disposition reports and any attachments. The Court finds the defendant's behavior warrants a sanction outside the Chapter 7 policy statements and accordingly, IT IS THE ORDER OF THIS COURT that defendant's supervised release is REVOKED. IT IS FURTHER ORDERED committing defendant to the custody of the Bureau of Prisons for a term of THIRTY-SIX (36) MONTHS. No Supervised Release to follow. Defendant is advised of his right to appeal within 10 days.

The defendant is remanded into the custody of the United States Marshal's Service. DATED this 20th day of December ,2007.
