Petition to Revoke Probation
COMES NOW PROBATION OFFICER John l\/lullavey presenting an official report on Rhonn
Ramon Carrillo who was placed on probation on October 19, 2004 by the Honorable Edward C. Voss
presiding in the District Court of Arizona. A three-year period of probation was imposed. In addition to
the general terms and conditions adopted by the court in General Order 04-1 1 , the offenderwas ordered
to comply with the following special conditions:
1. You shall participate as instructed bythe probation officer in a program of substance abuse
treatment which may include testing for substance abuse. You shall contribute to the cost
of treatment in an amount to be determined by the probation officer.
2. You shall submit your person, property (including but not limited to computer, electronic
devices, and storage media), residence, office, or vehicle to a search conducted by the
probation officer, at a reasonable time and in a reasonable manner.
3. You shall participate in a mental health program as directed by the probation officer which
may include taking prescribed medication. You shall contribute to the cost
of treatment in an amount to be determined by the probation officer.
4. You shall complete 40 hours of community service at the rate of not less than 4 hours per
month as approved and directed by the probation officer, to be completed by 08/19/07.
5. You shall abstain from all use of alcohol and alcoholic beverages.
Rhonn Ramon Carrillo was convicted of delay of mail.
RESPECTFULLY PRESENTING PETITION FOR ACTION OF COURT FOR CAUSE
AS FOLLOWS:
A. Violation of Special Condition No. 1.: You shall participate as instructed by the probation
officer in a program of substance abuse treatmentwhich may include testing for substance
abuse. You shall contribute to the cost of treatment in an amount to be determined by the
probation officer.
The defendant failed to submit to urinalysis as directed on June 2, 2005, Juiy 29, 2005 and August
2, 2005 as directed. (Grade C violation)

B. Violation of Special Condition No. 1.: You shall participate as instructed by the probation
officer in a program of substance abuse treatment which may include testing for substance
abuse. You shall contribute to the cost of treatment in an amount to be determined by the
probation officer.
The defendant failed to participate as instructed in outpatient substance abuse treatment at TASC
as directed by the probation officer. (Grade C violation)
C. Violation of Special Condition No. 4.: You shall complete 40 hours of community service
at the rate of not less than 4 hours per month as approved and directed by the probation
officer, to be completed by 08I19l07.
The defendant failed to complete 40 hours of community service at a rate of not less than 4 hours
per month as directed. (Grade C violation)
D. Violation of Standard Condition No. 3: You shall report to the Probation Office as directed
by the Court or the probation officer and shall submit a truthful and com plete written report
within the first five days of each months.
The defendant failed to submit written reports for the months of April, |\/lay, June and July, 2005.
(Grade C violation)
E. Violation of Standard Condition No. 9: You shall not purchase, use, distribute, or
administer any narcotic or other controlled substance as defined in section 102 of the
Controlled Substances Act (21 U.S.C. § 801) or any paraphernalia related to such
substances, without a prescription by a licensed medical practitioner. Possession of
. controlled substances will result in mandatory revocation of your term of supervision.
The defendant used methamphetamine on or about February 7, 2005 as evidenced by positive
urinalysis and admission. (Grade C violation)
F. Violation of Standard Condition No. 13: You shall immediately notify the probation officer
(within 48 hours if during a weekend or on a holiday) of being arrested or questioned by
a law enforcement officer.
The defendant failed to notify the probation officer that he was questioned by the Mesa
Police on August 7, 2005. (Grade C violation)
G. Violation of Standard Condition No. 19: You shall pay any monetary penalties as ordered
by the Court. You will notify the probation officer of any material change in your economic
circumstances that might affect your ability to pay restitution, fines, or special
assessments.
The defendant failed to make payments toward restitution of $50 per months as directed by the
probation officer. (Grade C violation)
