The current trial date is 9/6/05 at 9:00 a.m. (5th setting). The Court notes that defendants Tomlinson (09) and Yanez-Aguirre (10) are scheduled for plea hearings before Magistrate Judge Mathis this week. Accordingly, IT IS ORDERED vacating today's status conference as to these two defendants only. Counsel for defendant Joseph Castillo (01) advises the Court that defendant Castillo's case will be resolved without trial and will contact the deputy clerk shortly to schedule a plea hearing. Counsel to file time to that he for defendant Rigoberto Corrales (13) advises the Court that he intends a motion to continue trial for that reason that he needs additional prepare and confer with his client. Counsel further advises the Court has not had meaningful contact with his client for several weeks.

Government having no objection, IT IS ORDERED resetting trial from September 6, 2005 to Tuesday, September 20, 2005 at 9:00 a.m. as to all defendants pending trial. Case 2:04-cr-00675-JAT Document 73 Filed 08/24/2005 Page 1 of 2

Excludable delay under Title 18 U.S.C. ยง 3161(h) will commence on 9/7/05 through 9/20/05, for a total of 13 days as to all defendants pending trial. IT IS ORDERED setting status conference on Friday, September 2, 2005 at 9:30 a.m. as to defendant Rigoberto Corrales(13) only. IT IS FURTHER ORDERED that defendant Rigoberto Corrales be present at the status conference. Defense counsel, Jason Leonard, is directed to contact his client regarding the status conference and trial date. If an additional continuance is deemed necessary, defense counsel for defendant Corrales shall file the appropriate motion and proposed form of order.

OTHER: This being a sealed case, IT IS ORDERED that these proceedings, minute entry and transcript be sealed.
