CR-04-0809-PHX-NVW UNITED STATES' NOTICE REGARDING REQUEST FOR APPEAL BRIEF

The Court has requested, by order dated September 20, 2006, that the Government supply the Court with a copy of its Appellee's Brief in the Court of Appeals concerning Defendant's direct appeal of his conviction and sentence. The Court has requested the Government's Brief to the extent it is relevant to Defendant's Motion for Release Pending Appeal. The Government provides notice to the Court that it has yet to file its Appellee's Brief in the Court of Appeals. The Government's Appellee's Brief is currently scheduled to be filed in the Court of Appeals by October 2, 2006. However, the Government has requested an additional 30-day extension of the filing date for it's Appellee's Brief. As set forth in the Government's Response to Defendant's Motion for Release Pending Appeal, the Government respectfully requests that the Court deny Defendant's Motion on the grounds that he presents an economic danger to the community.
