OTHER: An ex-parte discussion is held with respect to a letter received by the Court from the Probation Officer. Present is Greg Clark and his client Gene Miller. Afterward, Mr. Clark and Gene Miller are excused and an ex-parte discussion is held with Joe Keilp and his client Grace Miller with respect to the letter. IT IS ORDERED sealing the letter and the ex-parte discussions held with the parties pending further order of court. The parties return to the courtroom for the sentencing proceedings. The Court has reviewed the sentencing material and advises that it is considering rejecting the Plea Agreements as to both defendants for reasons stated on the record. Argument heard. IT IS FURTHER ORDERED that the requested tax returns be filed today, and that the financial affidavits that were provided to the defendants, which they agreed to fill out, be filled out and provided to the probation officer no later than January 20, 2006. IT IS FURTHER ORDERED that the Government file a memorandum with respect to the following issues, selection of victims with respect to restitution in the criminal case, computation of loss figures and issue concerning stipulation as to level 14. IT IS FURTHER ORDERED vacating the sentencing proceedings and resetting sentencing for Monday, February 13, 2006 at 1:30 p.m. as to both defendants.
