Defendant, Jose Parra-Mariscal, by and through undersigned counsel, hereby moves the Court to enter an order continuing the currently scheduled sentencing hearing of August 22, 2005, to September 12, 2005 at 10:00 a.m. pursuant to Rule 12, Federal Rules of Criminal Procedure; 18 U.S.C. §3161; the 4th, 5th, 6th, 8th, and 14th Amendments to the United States Constitution; and for the reason set forth below. The reason for this request is that counsel for defendant has a calendar conflict. He will be attending an adjudication hearing in Superior Court Juvenile Division, in case JV537534, State of Arizona v. Francisco Galindo. Therefore will be unable to attend the sentencing hearing currently scheduled for August 22, 2005. Defense counsel has contacted Assistant United States Attorney Lisa Settel and she has no objection to the requested continuance. //

Wherefore, defendant requests the court continue the currently scheduled sentencing hearing of August 22, 2005, at 10:30 a.m., to September 12, 2005 at 10:00 a.m. Excludable delay under 18 U.S.C. §3161(h)(8)(A) will occur as a result of this motion or of an order based thereon.
