Upon motion of the defendant to continue to trial date and in order to avoid a

miscarriage of justice, the court finds that for the reasons set forth in the motion, the ends of

justice served by the granting of such continuance outweigh the best interest of the public

and the defendant in a speedy trial, therefore,

IT IS HEREBY ORDERED that the defendant's request for a continuance of the

August 9, 2005 trial date is granted.

IT IS FURTHER ORDERED that the case is continued for trial to October 11, 2005
