IN THE UNITED STATES DISTRICT COURT FOR THE DISTRICT OF ARIZONA UNITED STATES OF AMERICA, Plaintiff, v. MIGUEL RAMIREZ UREA, AKA MIGUEL F. OROPEZA, Defendant. ) ) ) ) ) ) ) ) ) )
CASE NO. CR 04-00868-001-PHX-FJM ORDER
Upon the motion filed by the defendant, Miguel Ramirez Urea, and for good cause shown, IT IS ORDERED continuing the jury trial now set for November 1, 2005, at 9:00 a.m. until December 6, 2005, at 9:00 a.m. Excludable delay under 18 U.S.C. §3161(h)(8)(A) and (B)(i) is found to commence between November 2, 2005, and December 6, for a total of 34 days. This Court specifically finds the ends of justice served by taking this action outweigh the interest of the public and the defendant in a speedy trial. This finding is based on the Court's conclusion that the failure to grant such a continuance would unreasonably deny the defendant and his attorney the reasonable time necessary for effective preparation, taking into account the exercise of due diligence. 18 U.S.C. §3161(h)(8)(A). DATED this 24th day of October, 2005.
