16 Defendant, Fabian Franco-Saenz, through undersigned counsel, asks this Court to
17 continue sentencing presently set for December 18, 2006. The reason to continue the
1 8 sentencing is that additional time is needed to tile objections and review revised Presentence
19 Investigation Report with defendant. A substantially amended PSR was disclosed on
20 December 4, 2006. The amendments involve supplemental information obtained during the
21 trial of the co—defendants. That information has been made available to U.S. Probation
22 Officer but not to counsel.
23 Therefore, undersigned counsel respectfully requests a 30 day continuance.
24 The Assistant United States Attorney assigned to this case, Lisa Settel, does not have
25 an objection to this motion.
26 Excludable delay under Title 18 U.S.C. §3 161(h)(1)(F) and (8)(A) may occur as a
27
result of this motion or from an order based thereon.
