Upon motion of defendant for a first request for extending time to file pretrial motions and continue trial, no objection from the government and good cause appearing, IT IS HEREBY ORDERED continuing the pretrial motions deadline for forty-five (45) days from the current date. This court specifically finds the ends of justice served by taking
this action outweigh the best interest of the public and the defendant in a speedy trial. This finding is based on the court's conclusion that the failure to grant such a continuance would unreasonably deny the defendant continuity of counsel and would deny the attorney for defendant the reasonable time necessary for effective preparation, taking into account the exercise of due diligence. 18 U.S.C. § 3161(h)(8)(b)(IV). IT IS FURTHER ORDERED continuing the trial from the current date of 1/4/2006 TO 3/7/2006, at 9:00 a.m., in Phoenix, Arizona. IT IS FURTHER ORDERED that excluded delay under Title 18 U.S.C. § 3161(h) will commence on 1/5/2006, for a total of 61 days.
