TIMOTHY A. SHIMKO, Plaintiff, v. DAVID GOLDFARB and RICHARD ROSS, et al., Defendants.

NOW COMES the Plaintiff, Timothy A. Shimko, and hereby submits his motion to strike: 1) the Goldfarb Defendants' joinder in Woodcock Defendants and Ross Defendants' motion to dismiss claims and motion for summary judgment (Document No. 195), and 2) the Declaration of David Goldfarb (Document No. 196). The basis for this motion to strike the Goldfarb Defendants' motion for summary judgment is because this Court previously established the dispositive motion cutoff date in its Rule 16 Scheduling Order (Document No. 163). In this Court's Rule 16 Scheduling Order this Court set the dispositive motion deadline as March 31, 2008. (See Paragraph No. 10 of the Scheduling Order.) This Court further stated on the first page of the Rule 16 Scheduling Order that there will be "no extensions to the dispositive motion cutoff date."

The Goldfarb Defendants' motion for summary judgment should be stricken from the record because it was filed late on April 14, 2008, which was two (2) weeks late! The Goldfarb Defendants apparently either disregarded this Court's Rule 16 Scheduling Order, or, they simply don't care about it. At any rate, the Goldfarbs have not followed this Court's Rule 16 Scheduling Order and their untimely motion should be stricken from the record. Wherefore, the Plaintiff requests that the Court strike the Goldfarbs' motion for summary judgment and the accompanying affidavit of David Goldfarb that was filed in support.
