private mediation before Tom Toone. Unfortnately, the mediation was unsuccessfuL.

Because we had hoped mediation would be successful, the Scheduling Order currently in place

does not include any deadlines beyond the deadline for completing the mediation process.

Accordingly, Scottsdale respectfully suggests that a Rule 16 Scheduling Conference is
