The parties by and through their respective counsel undersigned hereby move to extend

17 the deadline ordered by the court to participate in a private mediation by no later than August
18 15, 2007, for a period of 45 days, or until October 1, 2007.

Counsel certify and agree that this request for extending the deadline is made in good

20 faith, will not prejudice the respective parties, and is not made for the purpose of delay. A
21 private mediation has been scheduled at the first available date of September 13, 2007 with
22 Thomas L. Toone as Mediator.

The additional extension requested will allow for unexpected

23 scheduling issues and/or one or more additional mediation sessions, if necessary and
24 appropriate.
