IN THE UNITED STATES DISTRICT COURT FOR THE DISTRICT OF ARIZONA S C O T T S D A L E I N S U R A N C E) COMPANY, an Ohio corporation, ) ) ) Plaintiff, ) ) v. ) ) MARKET FINDERS INSURANCE) C O R P O R A T I O N , a K e n t u c k y) corporation, ) ) Defendant. ) _________________________________ ) No. CIV 04-0118-PHX-SMM ORDER
Defendant Market Finders Insurance Company has filed a Motion to Allow Telephonic Appearance at Hearing [Doc. No. 58]. The parties, two foreign insurance groups doing business in Arizona, have informed the Court that disputed discovery matters are unresolvable. In some measure, the parties have rendered these issues unresolvable. Having a corporate representative personally present will assist the Court in resolving this matter. Thus, the Court finds that Defendant has not set forth good cause to allow its corporate representative to appear telephonically and also finds that it will not be an economic hardship on the corporate representatives to appear personally. Accordingly, IT IS HEREBY ORDERED that Defendant's Motion to Allow Telephonic Appearance at Hearing [Doc. No. 58] is DENIED. IT IS FURTHER ORDERED that all parties shall comply with the Court's Order filed on March 14, 2006 [Doc. No. 57].
