Petitioner 17 in his Motion swears under oath that he is indigent and is financially unable to pay the cost 18 of an attorney. Plaintiff is presently incarcerated. 19 The Court finds that the interests of justice require the appointment of counsel for 20 Petitioner. See 18 U.S.C. § 3006A, which authorizes the district court to appoint counsel for 21 any "financially eligible person," including a state prisoner who "is seeking relief under 22 section ... 2254 of title 28." 23 Accordingly, 24 IT IS ORDERED that Petitioner's Motion for Appointment of Counsel (Dkt. 36) is 25 granted. 26 // 27 // 28
