who has personal responsibility for trying this case.

On September 21, 2005, this Court set this case for a jury trial commencing on
18

December 6, 2005.

However, on September 9, 2005, the Honorable David G. Campbell scheduled
20

a trial in D'Aguanno v. American Builders & Contractors Supply Co., Inc. d/b/a ABC
21

Supply Company, Inc., No. CV-03-1408-PHX-DGC, commencing on December 5, 2005,
22

and scheduled to last for five days.

Plaintiff's counsel apologizes to the Court for not alerting the Court of this trial date conflict at the September 21, 2005 status conference. However, because the trial in D'Aguanno had just been recently scheduled, the date had yet to be placed on Mr. Montoya's hand-held calendar, and he was consequently unaware of the D'Aguanno trial date at the status conference in this case.
