YOU ARE HEREBY NOTIFIED that pursuant to Rules 26 and 30 of Ariz.R.Civ.P., the deposition will be taken upon oral examination of the person whose name and address is stated below, before an officer authorized by law to administer oaths. This will be a video deposition. The deposition is being scheduled at this date and time because Edward Garvey refuses to produce Mrs. Jackson at any other date and time. This deposition was originally noticed for September 21, 2005 at 4:00 pm. Subsequently, Mr. Garvey stated that Mrs. Jackson would not be attending any deposition. After the Court ordered Mrs. Jackson to participate in a deposition, Mr. Garvey refused to produce her at any time except for September 20, 2005 at 9:30 am even though counsel had offered September 19, 2005 at 9:30 am, September 20, 2005 at 2:30 pm and September 22nd at any time. The undersigned explained that she was scheduled to be a Judge Pro Tem in Superior Court at 9:30 a.m. on September 20, 2005, and Mr. Garvey stated that since it was not surgery or a trial, he would not agree to an alternate date.
