L.R.Civ.P. 56.1. Defendants FUBU The Collection, LLC and GTFM of Orlando, LLC d/b/a

6 FUBU Company Store ("GTFM of Orlando")(collective|y referred to as the "FUBU
7 Defendants"). move this Court for an order striking portions of Plaintiffs Fred "Curly" Neal
8 ("Neal"). Marques I-laynes ("Haynes"). Robert "Showboat" Hall ("1-1a1l"). Larry "Gator" Rivers
9 ("Rivers"), Dallas "Big D" Thomton ("Thornton") and James "Twiggy" Sanders’ (“Sanders")
10 (collectively, the "Neal Plaintiffs") Reply to GTFM, LLC’s Opposition to the Neal Plaintiffs’

On December 13, 2005, the Neal Plaintiffs filed their Reply in support oftheir Motion for

lll summary judgment against GTFM, LLC. Although that pleading is entitled "Plaintiffs Neal.
15 Rivers, Thomton, Hall, Haynes and Sanders’ Reply to Defendant GTFM LLC’s Response to
16 Motion for Summary J`udgment," it is improperly directed toward all of the F UBU
17 Defendants, including FUBU The Collection, LLC and GTFM of Orlando. Specifically.
18 Point I ofthe Reply is entitled "Summary Judgment As To All Parties" and argues that the Neal
19 Plaintiffs’ Motion should be granted against all of the FUBU Defendants.

The present motion is supported by the FUBU Defendants’ Memorandum of Law in

Support of its Motion to Strike submitted herewith.
