While Plaintiffs do not concede that FUBU The Collection, LLC and GTFM of Orlando PLAINTIFFS' RESPONSE TO DEFENDANTS' MOTION TO STRIKE Plaintiffs, Fred "Curly" Neal, Larry "Gator" Rivers, Dallas "Big D" Thornton, Robert "Showboat" Hall, Marques Haynes, and James "Twiggy" Sanders, (hereinafter "Plaintiffs"), hereby respond to the Motion to Strike filed by Defendants FUBU The Collection, LLC and GTFM of Orlando, LLC d/b/a FUBU Company Store ("GTFM of Orlando")(collectively referred to as the "FUBU Defendants") as follows: 1. Plaintiffs would first state that they have received no contact whatsoever from the FUBU Counter-defendant.

FUBU Defendants filed a Response in Opposition to Plaintiffs' Motion to Dismiss the

FUBU Defendants. (Doc. 177). FUBU Defendants would not agree to dismissal without prejudice and would only welcome such dismissal being made with prejudice as stated in their opposition. 5. Plaintiffs filed their Motion for Summary Judgment (Doc. 279) against FUBU Defendants

directed primarily to GTFM, LLC while the Motion to Dismiss was pending. On October 14, 2005, FUBU Defendants GTFM of Orlando, LLC and FUBU the Collection, LLC filed a "Renewed Motion for

requested such in its conclusion. This is corrected in the Notice of Errata. This Court still may, sua sponte, order summary judgment against all FUBU Defendants, notwithstanding Plaintiffs' Motion for Summary Judgment being directed to GTFM, LLC only. DATED this 15th day of December, 2005.
