Plaintiff, vs. NOTICE OF ERRATA HARLEM GLOBETROTTERS INTERNATIONAL, INC., et al.; Defendants. Plaintiff, Meadowlark Lemon, through undersigned counsel hereby moves the Court to make a correction to Plaintiffs' Joint Response to Defendants' Motion In Limine to Exclude Evidence and Witnesses Disclosed After the Discovery Deadline (Doc. #539). On the chart contained on page 4 of "Exhibit A" to the Motion, Plaintiffs inadvertently left off the dates as to when Cynthia Lemon, Ben Green, and Jerry Saperstein were disclosed as witnesses to Defendants. This was simply an oversight. The Chart should indicate that Cynthia Lemon was disclosed on November 24, 2004 in the Supplement to Plaintiff's Answers to Defendant Harlem Globetrotter International, Inc.'s First Set of Interrogatories, again on August 7, 2005 in Plaintiff's Answers to Defendant Harlem

Globetrotter International, Inc.'s Third Set of Written Discovery on Plaintiff Meadowlark Lemon, again on August 19, 2004 in Plaintiff's Answers to Defendant Harlem Globetrotter International, Inc.'s First Set of Interrogatories, and again on May 17, 2005 in Plaintiff's Answers to Defendant Harlem Globetrotter International, Inc.'s Second Set of Interrogatories (although it is labeled as first request). The Chart should also indicate that Ben Green was disclosed on November 3, 2005 in Plaintiff's Third Supplemental Disclosure Statement and Jerry Saperstein was also disclosed on November 3, 2005 in Plaintiff's Third Supplemental Disclosure Statement. Plaintiff therefore requests that the court note that page 4 of the chart attached as Exhibit "A" to Plaintiffs' Joint Response to Defendants' Motion In Limine to Exclude Evidence and Witnesses Disclosed After the Discovery Deadline should have listed the above noted dates of disclosure for Cynthia Lemon, Ben Green, and Jerry Saperstein.
