‘ of deposition in this matter. While we are sure that it was not intentional, the discovery ‘
. `· requests are improper under the Federal Rules of Civil Procedure. Rule 26(d) provides:

To date this case is still not at issue and the meeting of the parties required
- under 26(d) has not taken place. Furthermore, this case is not exempt from the ’

reason, we request that you voluntarily agree to withdraw the discovery requests and the ·
deposition notice in order that we can avoid the filing of a Motion for Protective Order. l
