On September 5, 2006, third party plaintiff Greg Hancock filed a Motion for Leave to File Motion for Rule 54(b) Judgment on Less than All Claims, the latter motion accompanying the motion for leave. The purpose of this limited response by third party defendant Snell & Wilmer, L.L.P. is to give notice to the Court and the parties that it will respond to the Motion for Rule 54(b) Judgment on Less than All Claims only upon the Court's grant of leave to file such motion, in accordance with any schedule prescribed by the Court, or within the time allowed by the Rules of Civil Procedure.
