Plaintiffs, counterdefendants, and third-party defendants (collectively, "Meritage") respond to Rick and Brenda Hancock, Rick Hancock Homes and RLH Development's (collectively "Rick Hancock Defendants") Request for Leave to Supplement the Record. The Rick Hancock Defendant's have asked this Court for leave to supplement the record in an attempt to provide support for the factual assertions included in there

Response to Meritage's Motion for Summary Judgment so as to be in compliance with Rule 56(e) and Local Rule 56.1(b). The Rick Hancock Defendants had ample opportunity to properly comply with Rule 56(e) and Local Rule 56.1(b) before making their Request for Leave. While the Rick Hancock Defendants have requested leave, they have not given any rationale explaining why leave is necessary. Instead, they request leave in the first sentence of their Response to Meritage's Motion to Strike the unsupported facts from their Response to Meritage's Motion for Summary Judgment and then they ignore the request until their conclusion. Thus, the Rick Hancock Defendants have not identified any

reasons or facts giving rise to good cause that would support granting leave to supplement the record. Therefore, leave should be denied. DATED this 9th day of April, 2007. SNELL & WILMER L.L.P.
