Hancock-MTH Builders, Inc., an Arizona corporation, Hancock-MTH Communities, Inc., an Arizona corporation, and currently d/b/a Meritage Homes Construction, Inc., an Arizona corporation, and Meritage Homes of Arizona, Inc., an Arizona corporation; Steven J. Hilton and Suzanne Hilton, husband and wife; John R. Landon and Debi Landon, husband and wife; Scott Keeffe and Vicky Keeffe, husband and wife; Roger Zetah and Jane Doe Zetah, husband and wife; and James Arneson and Zane Arneson, husband and wife, Third-Party Defendants.

The Court has been informed by Stipulation that Plaintiffs, Meritage Homes Corporation, a Maryland corporation, formerly d/b/a Meritage Corporation, Hancock-MTH Builders, Inc., an Arizona corporation, Hancock-MTH Communities, Inc., an Arizona corporation, and currently d/b/a Meritage Homes Construction, Inc., an Arizona corporation, and Meritage Homes of Arizona, Inc., an Arizona corporation, (hereinafter collectively "Meritage"), Defendants, Ricky Lee Hancock and Brenda Hancock, husband and wife, Rick Hancock Homes, L.L.C., an Arizona limited liability company, RLH Development, L.L.C., an Arizona limited liability company, (hereinafter collectively "Rick Hancock Defendants") and Third Party Defendants, Steven J. Hilton and Suzanne Hilton, husband and wife, John R. Landon and Eleanor Landon, husband and wife, Scott Keeffe and Vicky Keeffe, husband and wife, Roger Zetah and Margaret Ann Zetah, husband and wife, and James Arneson and Zane Arneson, husband and wife, (hereinafter collectively "Meritage Individuals"), have reached a settlement in this matter. Based upon the Stipulation of the parties, and good cause appearing, IT IS HEREBY ORDERED, ADJUDGED AND DECREED all claims of Meritage against the Rick Hancock Defendants only are dismissed with prejudice and all claims of the Rick Hancock Defendants against Meritage and the Meritage Individuals are dismissed with prejudice.

Each party shall bear their own respective attorneys' fees and costs. Pursuant to F.R.C.P. 54(b), no just reason exists for delaying entry of this Order and the Clerk of the Court is directed to enter this Order forthwith.
