Defendant Greg Hancock has suggested that he can rely on the Settlement to show that Plaintiffs' claims against the Rick Hancock Defendants had no merit. The Settlement and its terms are, to the contrary, neither relevant to nor probative of any fact or defense that remains in issue. The only reason for making reference to the Settlement would be to unduly prejudice Plaintiffs in making their case to the fact finder. The Court should therefore preclude Defendants from making any reference to the Settlement at trial.
