18 The Court has been informed by Stipulation that Plaintiffs, Meritage Homes
19 Corporation, a Maryland corporation, formerly d/b/a Meritage Corporation, Hancock-MTH
. 20 Builders, Inc., an Arizona corporation, Hancock-MTH Communities, Inc., an Arizona
21 corporation, and currently d/b/a Meritage Homes Construction, Inc., an Arizona corporation,
22 and Meritage Homes of Arizona, Inc., an Arizona corporation, (hereinafter collectively
U 23 "Meritage"), Defendants, Ricky Lee Hancock and Brenda Hancock, husband and wife, Rick
24 Hancock Homes, L.L.C., an Arizona limited liability company, RLH Development, L.L.C.,
25 an Arizona limited liability company, (hereinafter collectively "Rick Hancock Defen·dants")
26 and Third Party Defendants, Steven J. Hilton and Suzanne Hilton, husband and wife, John

I and wife, Roger Zetah and Margaret Ann Zetah, husband and wife, and James Ameson and
2 Zane Ameson, husband and wife, (hereinafter collectively "Meritage Individuals"), have
3 reached a settlement in this matter.
4 Accordingly,
5 IT IS ORDERED all claims of Meritage against the Rick Hancock Defendants only
6 are dismissed with prejudice and all claims ofthe Rick Hancock Defendants against Meritage
7 and the Meritage Individuals are dismissed with prejudice. Each party shall bear their own
8 respective atto1·neys’ fees and costs. -
9 IT IS FURTHER ORDERED Meritage is reminded to exercise care in the filing of
10 documents. Further errors in filing will result in sanctions. ·
