Meritage Homes Corporation and Greg Hancock (hereinafter referred to as "the parties") hereby stipulate and respectfully request that the Court set a Rule 16 Scheduling Conference for the orderly resetting of the trial date. As the Court may recall, on

September 17, 2007, it vacated a trial date set for October 16, 2007. The Court furthered ordered all parties to attend a Settlement Conference with Judge Carroll. That Settlement

Conference took place on December 14, 2007, but failed to lead to a settlement. Negotiations are no longer ongoing. In that light, the parties believe that the matter should be reset for trial.
