17 I, Lindsey M. Perez, declare as follows:
18 1. I am at least 18 years of age, and I make this Declaration in the above-

19 captioned matter.
20 2. I am employed with Snell & Wilmer, L.L.p., which represents Plaintiff

21 Meritage Corporation in this matter.
22 3. The process for filing Plaintiffs' Response to Defendant's Rule 50 Motion for

23 Dismissal or Directed Verdict began before 9 :00 a.m.
24 4. The Response took several minutes to fie due to the number of exhibits that

25 had to be inputted and listed per the United States District of Arizona Electronic Case

2 5. The reason that the filing was not earlier was due to a transcription error for

3 Allson Sommerhalter's trial testimony. It could not be located because it was
4 inadvertently marked as Desiree Coates' testimony.

5 6. The fiing was expedited without any delay and was completed before the time

6 stamp put on by the District of Arizona.
7 Pursuant to the Rules of Civil Procedure, I declare under the penalty of perjury and
