IN THE UNITED STATES DISTRICT COURT FOR THE DISTRICT OF ARIZONA

Barbara Allen, Richard Dippold, Melvin Jones, Donald McCarty, Richard Scates and Walter G. West, individually and on behalf of all others similarly situated, Plaintiffs, vs. Honeywell Retirement Earnings Plan, Honeywell Secured Benefit Plan, Plan Administrator of Honeywell Retirement Earnings Plan, and Plan Administrator of Honeywell Secured Benefit Plan, Defendants.

Pursuant to Fed.R.Civ.P. 26(c), the parties stipulate to the entry of their proposed Confidentiality Order to ensure confidentiality of sensitive, personal information. This ERISA action raises issues concerning retirement benefits for a large number of current and former Honeywell employees, and the parties expect that discovery will involve the production of a large number of documents that contain private and personal information about employees and former employees, including, for example, salary and other compensation information, social security numbers, and addresses and phone numbers. The proposed Confidentiality Order is narrow in scope to limit the Confidentiality Order to this type of information, information over which the public can have no strong interest in obtaining and which individuals have a strong interest in keeping private. Moreover, it does not preclude the use at trial of any documents, but merely provides a mechanism to allow a party to seek further relief from the Court in the event that another party intends to use confidential material at trial. Thus, the proposed Confidentiality Order does not run afoul of any public interests. Cf. Phoenix Newspapers, Inc. v. United States District Court for the District of Ariz., 156 F.3d 940 (9th Cir. 1998). Accordingly, the parties request that the Court approve and enter their proposed Confidentiality Order to ensure proper protection of sensitive personal information. See, e.g., Phillips ex rel. Estates of Byrd v. G.M. Corp., 307 F.3d 1206, 1210-11 (9th Cir. 2002).
