Whereas, pending before this Court is Plaintiffs' Motion for Class Certification; Whereas, on November 21, 2005, before Defendants' response to the Motion for Class Certification had been filed, this Court entered its Order staying all proceedings until the 9th Circuit Court of Appeals ruled upon the issues raised in Defendants' Petition for Permission to Appeal filed with the 9th Circuit Court of Appeals; Whereas, on February 24, 2006, the 9th Circuit Court of Appeals issued an order denying Defendants' Petition for Permission to Appeal; Whereas, on March 2, 2006, this Court issued its Order setting a scheduling conference for April 13, 2006; and Whereas the parties wish to establish a schedule governing the completion of briefing on the Motion for Class Certification; Therefore, IT IS HEREBY stipulated by and between counsel for Plaintiffs and Defendants that: (1) Defendants shall file their Response to Plaintiffs' Motion for Class Certification on or before April 3, 2006; and (2) Plaintiffs' shall file their Reply to Defendants' Response on or before May 5, 2006. The Parties further request that the Court address at the April 13, 2006, scheduling conference the setting of a date for oral argument on the Motion for Class Certification.
